On January 15, 2025, the City of Bee Cave received the signed order from Judge Eiserloh. The order sets the trial for August 18, 2025.
The Court enjoined Defendants from any conduct that would violate the noise ordinance that Defendants agreed to follow in the Development Agreement. The Court’s findings confirm the harm this development has caused to residents and supports the city’s claim that Defendants breached the Development Agreement.
The City of Bee Cave believes Defendants’ proposed use of an industrial distribution center would further violate this order if they follow through with their original plans, as the order limits any use that would exceed the permissible limits in the noise ordinance.
Defendants claimed desire to seek a quick resolution to the city’s concerns is contradicted by a history of skirting the city’s oversight that is coming to light in discovery. The city’s legal team is continuing its investigation into that pattern and will amend its pleadings as necessary. The city remains focused on ensuring accountability and protecting the community from this industrial warehouse.
