
The City of Bee Cave is providing this update following a hearing on April 14, 2025 regarding the City’s second Motion to Compel seeking to require Defendant and industrial warehouse developer, Velocis, to release key documents that have been withheld.
Judge Catherine A. Mauzy of the 419thDistrict Court issued the following rulings on April 17, 2025.
Judge Mauzy ruled that Velocis must turn over the following documents to the City of Bee Cave by April 24 at 5 p.m.:

All documents related to the financial interests in the Sweetwater Property, Warehouse Facility, or Project.

Documents and communications relating to or otherwise reflecting the subcontractors used in connection with development on the Sweetwater Property, including construction or development of the Warehouse Facility.

Documents sufficient to identify all persons or entities with a direct financial interest in the Sweetwater Property, the Project, or the Warehouse Facility, such as organizational and governance documents, agreements reflecting ownership or controlling interests; financing or loan agreements; or any other document reflecting an obligation to share in profits, proceeds, or revenue from the Sweetwater Property, the Project, or the Warehouse Facility.

Documents sufficient to identify all persons or entities with a direct financial interest in Velocis, such as organizational and governance documents, agreements reflecting ownership or controlling interests; financing or loan agreements; or any other document reflecting an obligation to share in Velocis’s profits, proceeds, or revenue.
Judge Mauzy also ruled that Velocis had improperly asserted the attorney-client privilege as a basis to withhold communications with various third parties, including Exeter EQ and their lawyers and the general contractor for the development. The Court ordered Velocis to produce those communications and to provide to the Court all other communications Velocis has withheld as privileged so she can assess whether Velocis’s claims of privilege are proper.
In addition, Judge Mauzy ruled Velocis must pay the City of Bee Cave for legal fees incurred in preparing and filing the Motion to Compel. The exact amount will be determined at a separate hearing.
These documents are part of the discovery process for this case that is expected to go to a jury trial in August 2025.
